STATE OF ALABAMA COUNTY OF ETOWAH CITY OF RAINBOW CITY-COUNCIL MEETING-OCTOBER 14, 2002 The City Council of the City of Rainbow City met in regular session City Hall at 6:30 P. M., and upon roll call the following members were present: Sue L. Glidewell, Mayor Council members: Billy Ray Colvin Frank Ramsey Ralph Slate Bryan Stone The same constituting a quorum of the City Council, the following business was transacted. 1. The meeting was called to order by Mayor Sue L. Glidewell. 2. Invocation was given by Ralph Slate. 3. Mayor Glidewell led the pledge of allegiance to the flag. 4. The minutes of September 23, 2002 were approved as presented, with an amendment to Item 8. The City authorizes the Utility Board to go back three months on a overcharge on garbage. 5. Mayor Glidewell presented a recommendation from Chief Wimpee to hire Jason Dorsett as fire fighter at $8.51 hourly. Ralph Slate moved and Billy Ray Colvin seconded the motion to hire Mr. Dorsett. Mayor Glidewell declared the motion carried. 6. Matt Parker, Joe Jolly & Co., Inc. appeared before the Council concerning the bond refunding for the City. Discussion followed. John Wilson, Merchants Capital also appeared before the Council concerning the bond refunding. Discussion followed. 7. Mayor Glidewell presented the annual appropriation of $5000.00 each for John Jones, Rainbow Middle, and Southside High. Bryan Stone moved and Billy Ray Colvin seconded the motion to grant the appropriations. Mayor Glidewell declared the motion carried. 8. Mayor Glidewell presented the Phase II Storm Water Permit Agreement, Resolution No. 02-05. Billy Ray Colvin moved and Bryan Stone seconded the motion to adopt the resolution. Mayor Glidewell declared the motion carried. 9. Mayor Glidewell presented a recommendation from Chief Wimpee to give Phillip Bowlin his one year pay increase. ($l0.49 hourly). Ralph Slate moved and Billy Ray Colvin seconded the motion to grant the pay increase. Mayor Glidewell declared the motion carried. 10. Mayor Glidewell presented a recommendation from Judge Martin and Melanie Thrasher, Court Clerk to give Sharon Wagnon a six-month pay increase of $.25 per hour. Billy Ray Colvin moved and Frank Ramsey seconded the motion to grant the pay increase. Mayor Glidewell declared the motion carried. 11. Mayor Glidewell presented a recommendation from the Detective Division to declare the following vehicles as surplus and accept bids on them until October 28, 2002 at 2:00 P. M. The minimum bid amount will be $500.00 on each vehicle. One (1) 1990 Olds Ninety Eight, Serial No. 8959 One (1) 1989 Ford Probe, Serial No. 2154 One (l) 1987 Ford Ranger 4X P\U, Serial No. 2362 One (l) 1986 Toyota Hilux P\U, Serial No. 2069 One (1) 1989 Olds Cutlass, Serial No. 8882 Billy Ray Colvin moved and Frank Ramsey seconded the motion to declare the vehicles as surplus and accept bids. Mayor Glidewell declared the motion carried. 12. Mayor Glidewell informed the Council that the Grand Opening for Regency Pointe will be November 7, 2002. She also presented an ad request from them for the Vendor Support Edition. Billy Ray Colvin moved and Bryan Stone seconded the motion to purchase a 1/4 page ad in the Gadsden Times in the amount of $400.00. Mayor Glidewell declared the motion carried. 13. Mayor Glidewell presented an ad from Comcast for the annual Christmas Greetings. The air dates are November 26-December 30, 2002. There will be sixty-15 second greetings for $525.00. Billy Ray Colvin moved and Frank Ramsey seconded the motion to purchase the ad. Mayor Glidewell declared the motion carried. 14. Mayor Glidewell presented a ½ page ad from the Etowah County Sports Hall of Fame Annual Program for $50.00. Bryan Stone moved and Frank Ramsey seconded the motion to purchase the ad. Mayor Glidewell declared the motion carried. 15. Mayor Glidewell presented the following travel\tuition: Tina Brooks to attend the APLS Administrators Meeting, Thursday, October l7 in Montgomery. Sergeant J. B. Jeffers to attend The Infrastructure of Terrorism and Terrorist Groups at Jackson International Airport in Jackson, Mississipi, October 30-31, 2002. Assistant Chief Kevin Conklin, Captain Tim Crow, Captain Slade Wilson, and Captain Mike Johnson to attend Fire Officer II Class, January 13-17, 2002. Ralph Slate moved and Billy Ray Colvin seconded the motion to grant the travel\tuition. Mayor Glidewell declared the motion carried. 16. Mayor Glidewell gave the following monthly departmental reports: Library, Community Center, Court, Fire Department and Police & Animal Control. 17. Mayor Glidewell spoke to the Council concerning the Business License Ordinance for the City. She reported that it had not been updated in twenty years. The league has worked on a uniform Business License Ordinance and the ordinance has been reviewed by our City Attorney. Mayor Glidewell recommended Mickey Williams and Cheryl Ayres in the Revenue Department review this ordinance and prepare the ordinance for the City. Billy Ray Colvin moved and Bryan Stone seconded the motion to update the ordinance. Mayor Glidewell declared the motion carried. 18. Mayor Glidewell presented a street light request: Pole #48, 4934 Rainbow Drive Ralph Slate moved and Bryan Stone seconded the motion to grant the street light request. Mayor Glidewell declared the motion carried. 19. Mayor Glidewell informed the Council that Chief Alexander, the City Engineer and City Attorney had looked at and checked on the barricade that was put up near Rainbow Apartments. She asked if there was anyone who would be speaking for or against the barricade. Harold Bowman, 1420 Steele Station Road, spoke in favor of the barricade. Discussion followed. Bobby Weathington, Doris Street spoke in opposition to the barricade, and presented a petition from surrounding neighbors. Discussion followed. J. D. Mostella, prior Apartment Manager spoke concerning the barricade. Discussion followed. H. W. Billingsley spoke in favor of the barricade. Discussion followed. Sara Walton told the Council that she put the barricade up. Discussion followed. 20. Bryan Stone moved and Frank Ramsey seconded the motion to send Ms. Walton a letter to take the barricade down. Mayor Glidewell declared the motion carried. 21. Frank Ramsey moved and Billy Ray Colvin seconded the motion to send a letter to Billy Husley, Arrlington Properties, owner of Rainbow Apartments to have him move the garbage container and place it on his property and to clean up the trash around the area. Mayor Glidewell declared the motion carried. 22. Mayor Glidewell presented a flag in honor of the Police and Fire Department that was flown over the Capital September 11, 2002. The flag was donated by Congressman Robert Aderholt. 23. Mayor Glidewell presented a thank-you letter from the Lady Cardinal Basketball Team thanking the City for their recent donation. 24. Mayor Glidewell read a letter from the United States Marshal, C. M. Keely, expressing his appreciation to Detective Charles Clifton and Sergeant Greg Carroll for the apprehension of a federal fugitive, and that the conduct of these officers is a positive reflection on the City and their department. 25. Mayor Glidewell informed the Council that the Solid Waste Authority gave one days notice to close the landfill. The City of Gadsden let the City take the garbage to their transfer station for three days. We are now using Superior Cedar Hill Landfill in Ragland at $25.00 per ton. 26. Billy Ray Colvin moved and Bryan Stone seconded the motion to send out bids for solid waste and C & D and open bids October 28, 2002 at 2:30 P.M. Mayor Glidewell declared the motion carried. 27. Billy Ray Colvin moved and Ralph Slate seconded the motion to give Joe Jolly & Co., the authority to start the paperwork on the refunding of the bond issue. Mayor Glidewell declared the motion carried. 28. Barry Gargus appeared before the Council concerning his campaign for District IV, County Commission. 29. Frank Ramsey presented a donation from Walter Majors in the amount of $l00.00 to the Fire Department for a job well done at his home recently. 30. Larry Murray appeared before the Council to let them know he helped build the pavilion at Pioneer Camp Ground on a Saturday of his own free will. It was his off day.
